Short answer: no. As of October 2026, recreational cannabis is still illegal in Pennsylvania. Only patients registered in the state’s medical marijuana program can buy it, from licensed Pennsylvania dispensaries. Neighboring New York allows adult-use sales to anyone 21 or older, but cannabis bought in New York has to stay in New York: carrying it back into Pennsylvania is illegal.
Pennsylvania is surrounded by states where adults can buy cannabis legally: New York, New Jersey, Maryland, Delaware and Ohio. That makes the question one of the most searched in the state. Here’s where the law stands, what’s changed, and what it means if you live around Erie.
Medical marijuana in Pennsylvania
Pennsylvania legalized medical marijuana in 2016. To buy it, you need:
- a qualifying medical condition, certified by a practitioner registered with the state;
- a registration with the Pennsylvania Department of Health’s medical marijuana program;
- a valid medical marijuana ID card.
Card holders can buy only from dispensaries licensed in Pennsylvania. Without a card, buying or carrying cannabis in Pennsylvania is still against state law.
Is recreational weed coming to Pennsylvania?
Not yet. In May 2025 the Pennsylvania House passed an adult-use legalization bill for the first time, but it stalled in the state Senate, where leaders disagree on how sales should work. As of this writing there’s no adult-use law, and most observers don’t expect one to pass before 2027.
Until that changes, possessing cannabis without a medical card can still lead to criminal charges under state law. Small amounts are usually charged as a misdemeanor, and some cities have softened their local penalties, but the state law hasn’t changed.
Where’s the closest legal adult-use cannabis to Erie?
Erie sits between two states with legal adult-use sales: Ohio to the west and New York to the east. Heading east on I-90, MuMu’s Irving is about an hour and five minutes from Erie (64.8 miles), on Southwestern Blvd in Irving, NY. It’s open 8 AM to 8 PM, seven days a week.
At MuMu’s you’ll find a big rotating flower menu sold by the ounce, plus pre-rolls, vapes, concentrates and edibles. Bring a valid government photo ID showing you’re 21 or older. Your Pennsylvania driver’s license works.
The rule that matters most: buy it here, use it here
Buying cannabis legally in New York doesn’t make it legal in Pennsylvania. If you buy in New York:
- Don’t take it back across the state line. Bringing cannabis into Pennsylvania without a medical card is illegal under Pennsylvania law, and moving cannabis across state lines is illegal under federal law.
- Use it in New York, where it’s legal. Adults can smoke wherever tobacco smoking is allowed, with some exceptions. It’s not allowed in cars, even parked ones.
- Never drive high. Driving while impaired by cannabis is a crime in both states. Plan a sober driver or a place to stay.
- Buy only what you’ll use during your visit. Leftovers become a problem at the state line.

Pennsylvania medical patients in New York
New York doesn’t recognize Pennsylvania medical cards, and it doesn’t need to: any adult 21 or older can buy at an adult-use dispensary in New York. But the same rule applies. Cannabis bought in New York isn’t covered by your Pennsylvania card, so don’t take it home.
